Child Custody & Overnight Visitation in Ghaziabad Family Court: The Shared Parenting Doctrine
How courts apply the Paramount Welfare Principle under the Guardians and Wards Act 1890 (GWA) and when they allow overnight weekend visitation and shared parenting.
The Child is Not a Chattel: Modern Custody Jurisprudence
Child custody disputes are often the most emotionally charged aspect of matrimonial breakdowns. Courts have moved towards shared parenting and overnight visitation where it serves the child's welfare, instead of limiting the other parent to short visits in court premises.
1. The Paramount Welfare Principle (Gaurav Nagpal v. Sumedha Nagpal)
Under the Guardians and Wards Act, 1890 and the Hindu Minority and Guardianship Act, 1956, neither parent has an absolute superior proprietary right over a minor child. In Gaurav Nagpal v. Sumedha Nagpal (2009) 1 SCC 42, the Supreme Court ruled that the physical, emotional, and educational well-being of the minor child is the paramount consideration, above the wishes of either parent.
2. What a Parenting Plan Can Ask For
- Overnight Weekend Access: The non-custodial parent can ask to pick up the child on Friday evening and drop the child back on Sunday evening, for example twice a month.
- School Vacations: A split of summer and winter holidays and festivals (Diwali, Holi, birthdays).
- Video Calls: Regular video calls on WhatsApp or FaceTime at fixed times.
- Relocation: An order restraining the custodial parent from taking the child out of Delhi-NCR or abroad without the court's permission.
3. Interim Custody and Visitation
Section 12 of the Guardians and Wards Act lets the court make interim orders about the child while the main petition is pending. In Ghaziabad that application goes to the Principal Family Court. It's often the first step when a parent has lost contact with the child, and every order turns on the child's welfare.
